1. About us

These Terms and Conditions (“Terms”) govern your use of https://www.yourmusictheorycoach.com (the “Site”) and the products and services we provide (together, the “Services”).

2. Definitions

  • Consumer means an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.
  • Digital content means data produced and supplied in digital form (for example videos, downloads, worksheets, and online course materials).
  • Subscription means a recurring payment plan that renews automatically until cancelled.
  • Billing period means the period covered by a subscription payment (for example monthly or 6-monthly).
  • Next billing date means the next renewal date shown in your account.

3. Eligibility & accounts

You must be 18 or over to purchase unless a parent/guardian purchases and supervises use. You are responsible for keeping your account login details secure and for all activity on your account.

You agree that the information you provide is accurate and up to date.

4. Our Services and Access

We provide music theory learning products including Digital content and, where offered, live sessions or tutoring.

Access is provided via your account on the Site. You are responsible for ensuring you have compatible devices, software, and internet connection.

We may update, replace, or re-organise content to improve the Services. We will not remove or materially reduce core paid features without reasonable justification. If a change materially reduces what you paid for, you may contact us to discuss appropriate remedies.

We may correct errors or inaccuracies on the Site (including pricing or descriptions) and update information at any time.

We do not guarantee uninterrupted access to the Site or Services. We may suspend, withdraw, or restrict access for maintenance, security, or operational reasons. We will try to minimise disruption where practicable.

5. Prices and Payments

Prices are shown on the Site (in GBP unless stated otherwise) and include any applicable taxes unless we state otherwise. Payment is taken at checkout using the payment methods offered.

6. Subscriptions, renewals, and billing

If you purchase a Subscription, you authorise us (and our payment providers) to charge your selected payment method on a recurring basis at the price and frequency shown at checkout.

Your Subscription renews automatically at the end of each Billing period unless you cancel before your Next billing date.

Your account area shows your Next billing date and provides a method to cancel your Subscription.

You are responsible for managing your Subscription (including cancelling before your Next billing date if you do not wish to renew). The renewal will occur automatically even if you have not accessed or used the Services during the billing period.

7. Cancellation

The Cancellation Policy forms part of these Terms. If there is any conflict between these Terms and the Cancellation Policy on cancellation or refunds, the Cancellation Policy will apply.

8. Refunds and your statutory rights

Our refund approach for Subscriptions is set out in our Cancellation Policy. Any refund requests are handled in line with our Cancellation Policy.

Nothing in these Terms limits your statutory rights. If Digital content is faulty or not as described, you may have rights to repair, replacement, or refund under UK consumer law.

If a payment is reversed or disputed (including a chargeback), we may suspend access to the Services while the dispute is investigated. If the dispute is resolved in our favour, access will be restored once payment is received. We reserve the right to provide evidence to payment providers that may include proof of purchase, account access records, and correspondence.

9. Right to cancel (Consumer Contracts)

If you are a Consumer and purchase Services online, you may have a legal right to cancel within 14 days in some circumstances.

Because our Services include digital content that is made available immediately (for example, instant access to course materials), the 14-day right to cancel may not apply once access to the digital content has begun.

This summary is provided for convenience and does not replace the legal position under the Consumer Contracts Regulations.

This does not affect your statutory rights if the digital content is faulty or not as described.

10. Acceptable use

You must not misuse the Site or Services. In particular, you must not:
  • Attempt to access other users’ accounts or our systems without permission
  • Copy, scrape, reverse engineer, or interfere with the Site
  • Upload malware, spam, or abusive content
  • Harass other users or our staff
  • Use the Services for commercial purposes without our written consent
  • Download, copy, or use any Digital content for commercial purposes, including using content in teaching, tutoring, or educational services provided to others
  • Share access to your account with students, pupils, or any other third party, or allow multiple users to access the Services via a single account
  • Download content in bulk with the intention of using it beyond your own personal study

10.1 Community content

When you post comments or other content in the community areas of the Site (“User Content”):
  • You confirm you own the content or have the rights to post it, and that it does not infringe anyone else’s rights or break any laws.
  • You grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, and make your User Content available within the Services for the purpose of operating and promoting the community.
  • We may moderate, remove, or restrict User Content at our discretion where we reasonably consider it breaches these Terms, applicable law, or community standards, or where it may expose us or other users to harm.
  • User Content is posted by users. It does not necessarily represent our views and we do not endorse it.

11. Intellectual property

We grant you a limited, personal, non-exclusive, non-transferable licence to access and use the Digital content for your own private study during your paid access period. You must not share your account, login credentials, or access with any other person, or allow any other person to use the Services via your account.

You must not copy, reproduce, distribute, sell, license, publish, upload, or make available any part of the Services or Digital content to any third party, including by screen recording, downloading and re-uploading, file sharing, or posting to social media.

You must not remove copyright notices or watermarks, or attempt to bypass any access controls or security measures on the Site.

You must not use any tool or method to bypass restrictions on streaming or downloading content, or to extract content from the Services.

12. Live sessions and tutoring

Where live sessions or tutoring are included in a plan or purchased separately:
  • Sessions may be delivered online
  • Scheduling and attendance requirements will be communicated in advance
  • We may reschedule for reasonable reasons and will provide notice where practicable
  • Missed sessions may be treated as forfeited unless we agree otherwise in writing

13. Money Back Guarantee

We offer a Money Back Guarantee. It applies only as described here:
  • Proof of failure provided from the ABRSM examination board within 14 days of notification of failure
  • Proof of course participation & completion in its entirety at least 14 days prior to examination date
  • Proof of each worksheet completion in its entirety at least 14 days prior to examination date
  • Proof of attempting at least 3 practice papers with a score of at least 50/75 on each, completed at least 14 days prior to examination date
  • Proof of Purchase
  • Email written to a GET MUSIC THEORY ONLINE LTD Director (reachable at joey@yourmusictheorycoach.com) stating why you believe you are eligible for the Money Back Guarantee
It does not limit your statutory rights.

14. Disclaimers

The Services are educational and outcomes depend on your effort, practice, and exam conditions. We do not guarantee exam results.

The Site may include links to third-party websites or services. We do not control and are not responsible for third-party content, policies, or availability. Your use of third-party services is at your own risk and subject to their terms.

15. Liability

Nothing in these Terms limits liability where it would be unlawful to do so, including for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

Subject to the above, we are not liable for losses that are not reasonably foreseeable.

Our total liability to you for any claim relating to a purchase is limited to the amount you paid for that purchase, unless a higher amount is required by law.

16. Suspension and termination

We may suspend or terminate access if you materially breach these Terms, misuse the Services, or we reasonably suspect fraud or unlawful activity. This includes serious or repeated breaches in community areas (for example harassment or posting unlawful content).

We may suspend or terminate your access immediately if we reasonably believe you have shared access, redistributed content, or breached Section 11 (Intellectual property). In such cases, no refund will be due for any unused portion of the current billing period, except where required by law.

19. Miscellaneous

  • Severability: If any part of these Terms is found unenforceable, the rest remains in force.
  • No waiver: If we delay enforcing these Terms, we do not waive our rights.
  • Assignment: We may transfer our rights and obligations under these Terms as part of a reorganisation or sale of the business.
  • Third-party rights: These Terms are between you and us. No third party has rights to enforce them.
  • Electronic Communications: You agree that we may communicate with you electronically (for example by email) and that such communications satisfy legal requirements for written communication where applicable.
  • Entire agreement: These Terms and the Cancellation Policy form the entire agreement between you and us relating to the Services.
  • Force majeure: We are not responsible for delays or failures caused by events outside our reasonable control.

20. Changes to these Terms

We may update these Terms from time to time by posting an updated version on the Site and updating the “Last updated” date. Continued use of the Site after changes take effect means you accept the updated Terms.

21. Governing law

These Terms are governed by the laws of England and Wales. Courts in England and Wales will have jurisdiction, except where consumer law in your country requires otherwise.
